Terms of Service and Sale

In short: KCD Points are a virtual currency for cosmetic and convenience items on KCDRoleplay.com. They have no cash value, they are delivered at once, and purchases are final and not refunded, except where the law says otherwise. By buying, you agree that the service starts immediately and you waive your right of withdrawal.

1. Who we are

KCDRoleplay.com ("we", "us") is a roleplay community and game server for Kingdom Come: Deliverance II, run by Ancad Studios, France. Payments for KCD Points are received by Ancad Studios through Stripe and PayPal.

KCDRoleplay.com is a fan project. It is not affiliated with, endorsed by or sponsored by Warhorse Studios, Deep Silver, PLAION or the makers of KCD:MP. Kingdom Come: Deliverance is their trademark; you need your own copy of the game to play.

2. The service

The service is the game server (play.kcdroleplay.com), the account site (account.kcdroleplay.com), the website, the wiki, the live map and our Discord. Playing is free. KCD Points are optional.

By making an account or using the service you accept these terms and the server rules published on our Discord and wiki.

3. Your account

One account is for one person. Keep your password to yourself: you are responsible for what is done with your account.
Give a true e-mail address. We use it for your account's safety, your purchases and the notices you ask for.
You may not sell, trade, lend or transfer your account, its characters or its KCD Points.
You may ask us to close your account at any time (section 17). Closing it ends your KCD Points and perks, without refund.

4. KCD Points

KCD Points are a virtual, digital currency, usable only on KCDRoleplay.com to obtain the items of our store.
They have no cash value. They cannot be exchanged for money, sold, transferred to another account, or cashed out, and they are not a payment instrument or electronic money.
They do not expire while your account exists and the service runs.
Points given for free (events, gifts, compensation) are the same, and may be taken back if they were given by mistake.

5. Buying KCD Points

Points are sold in packs. Prices are shown in euros, taxes included, before you pay. The price charged is the one shown when you confirm.
Payment is made through Stripe (cards) or PayPal. We never see or store your card details; their own terms and privacy policies apply to the payment.
Points are credited to your account as soon as the payment provider confirms the payment, usually within seconds. If they do not arrive within an hour, write to us with the date and the amount.
You must be allowed to use the payment method, and, if you are a minor, have your parent's or guardian's consent (section 11).

6. No right of withdrawal

KCD Points and the items they buy are digital content supplied immediately, not on a tangible medium. When you buy them, you expressly agree that the supply starts at once and you acknowledge that you thereby lose your right of withdrawal (article 16(m) of Directive 2011/83/EU; article L221-28 13° of the French Consumer Code). The checkbox on the purchase page records this agreement.

7. No refunds

All purchases of KCD Points, and all spending of KCD Points in the store, are final. We do not refund them, in money or in points, including when you stop playing, are sanctioned, close your account, or change your mind.
This does not limit the rights the law gives you: if a purchase was charged twice, or points you paid for never arrived and we cannot credit them, we refund that payment.
If we close the service for good, we will give notice beforehand; points will not be converted into money.

8. Chargebacks and fraud

If you dispute a payment with your bank or PayPal instead of writing to us, or if a payment turns out to be fraudulent, we may take back the points and items it bought, and suspend or close the accounts involved. Please write to us first: most problems are solved within a day.

9. What points buy

The store sells cosmetic and convenience items: name changes, character slots, dogs, a wax seal, notices, community roles and packs of these. They give no coin, gear, levels or combat advantage in the game.
Items with a duration (for example "for three months") run from the purchase, whether you play or not. Buying again adds to the time left.
A Discord role needs your Discord account to be linked and to stay on our server; we may remove it if you break Discord's or our rules.
Items are a licence to use a feature of the service, not property. We may change how an item works, rebalance it or retire it; if we retire an item with time left, we give an equivalent or the points back.

10. Conduct and sanctions

The server rules apply to everyone, buyers or not. Breaking them may lead to warnings, a jail, a ban of a character or of the account, temporary or permanent. A sanction does not give a right to a refund of points or items. Buying points never protects an account from the rules.

11. Minors

You must be old enough to play Kingdom Come: Deliverance II where you live. If you are under 18, you may buy KCD Points only with the consent of a parent or guardian, who accepts these terms for you.

12. Availability and changes

We do our best to keep the service running, but it is offered as it is: restarts, updates, outages and changes to the game or to KCD:MP may interrupt it, and the game world may change or be reset in part.
We may change these terms. The date at the top shows the last change; important changes are announced on our Discord. Using the service after a change means you accept it. Purchases already made stay under the terms of their day.

13. Liability

To the extent the law allows, we are not liable for indirect losses, for the loss of in-game progress, items or currency, or for what other players do. Our total liability for a purchase is limited to the amount paid for it. Nothing in these terms limits a liability that the law does not allow to be limited.

14. Your data

We keep: your account name, a hash of your password (never the password itself), your e-mail, your characters and what they do in the game, your purchases and point history, your Discord identifier if you link it, and technical logs (IP addresses, connections) for security.
We use them to run the service, keep it safe, handle your purchases and send you the messages you ask for. We do not sell them.
Payment data is handled by Stripe and PayPal. Mail is sent through Google Workspace. Our servers are in the European Union.
You may ask to see, correct or delete your data (GDPR) by writing to us. Purchase records are kept as long as the law requires.

15. Intellectual property

The website, the account site, the game mode and their content are ours or used with permission. What you write in the game or on our sites stays yours, but you let us show it within the service (for example your character's description or letters).

16. Law and disputes

These terms are governed by French law. If you are a consumer, you also keep the protection of the law of the country where you live. Write to us first: we try to settle every dispute amicably. EU consumers may also use a consumer mediator or the European Commission's online dispute resolution platform. Otherwise, the competent courts are those the law designates.
